profit\uff09\u4e4b\u8209\u8b49\u8981\u6c42\u8f03\u8f15\uff0c\u800c\u5408\u7406\u7684\u5be6\u65bd\u5831\u916c\u91d1\uff08reasonable royalty\uff09\u88c1\u91cf\u6b0a\u4ea6\u5f88\u5927\u3002<!--more--><\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>\u5c08\u5229\u4fb5\u5bb3\u4e4b\u6551\u6fdf\u624b\u6bb5\uff08remedies\uff09\u53ef\u5206\u70ba<br>1) \u7981\u5236\u4ee4\u2014\uff08injunctions\uff09<br>\u5206\u70ba\u2460\u6c38\u4e45\u7981\u5236\u4ee4\uff08permanent injunction\uff09<br>\u2461\u9810\u5099\u7981\u5236\u4ee4\uff08preliminary injunction\uff09<br>2) \u640d\u5bb3\u8ce0\u511f\uff08damages\uff09<\/li>\n\n\n\n<li>\u7981\u5236\u4ee4\n<ol class=\"wp-block-list\">\n<li>\u6c38\u4e45\u7981\u5236\u4ee4\n<ul class=\"wp-block-list\">\n<li>\u7981\u5236\u4ee4\u70ba\u4f9d\u8861\u5e73\u6cd5\uff08equity\uff09\u4e4b\u6551\u6fdf\u624b\u6bb5\uff0c\u6cd5\u9662\u6709\u6b0a\u88c1\u91cf\uff0c\u4f46\u5982\u5c08\u5229\u6709\u6548\u6027\u53ca\u5c08\u5229\u4fb5\u5bb3\u884c\u70ba\u5747\u5b58\u5728\u6642\uff0c\u5247\u539f\u5247\u4e0a\u5bb9\u8a31\u767c\u7d66\u7981\u5236\u4ee4\u3002<\/li>\n\n\n\n<li>\u4f8b\u5916\u4e0d\u767c\u4e4b\u60c5\u5f62\uff0c\u4f8b\u5982\u516c\u76ca\uff0c\u5373\u4e0b\u6c34\u9053\u5c0d\u516c\u5171\u885b\u751f\u6709\u5bb3\uff1b\u6cdb\u6709\u66ff\u4ee3\u85e5\u54c1\uff0c\u5c08\u5229\u6b0a\u4eba\u4f9b\u61c9\u80fd\u529b\u4e0d\u8db3\uff1b\u6216\u8005\u56e0\u5c08\u5229\u6b0a\u4eba\u672c\u8eab\u672a\u5be6\u65bd\u5c08\u5229\u4e14\u672a\u6388\u6b0a\u4ed6\u4eba\u4f7f\u7528\uff0c\u5982\u767c\u7d66\u7981\u5236\u4ee4\u5247\u5c0d\u4fb5\u5bb3\u8005\u4e0d\u5229\u6bd4\u5c0d\u5c08\u5229\u6b0a\u4eba\u4e4b\u5229\u76ca\u66f4\u5927\u6642\uff1b\u5982\u6b64\u5247\u53ef\u62d2\u7d55\u767c\u7d66\u7981\u5236\u4ee4\u3002<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>\u9810\u5099\u7981\u5236\u4ee4\n<ul class=\"wp-block-list\">\n<li>\u548c\u5047\u8655\u5206\u76f8\u4f3c\uff0c\u5728\u672c\u8a34\u4e2d\u7531\u539f\u544a\u63d0\u51fa\uff0c\u5176\u6548\u529b\u6301\u7e8c\u81f3\u5224\u6c7a\u70ba\u6b62<\/li>\n\n\n\n<li>\u7533\u8acb\u9810\u5099\u7981\u5236\u4ee4\u5fc5\u9808\n<ul class=\"wp-block-list\">\n<li>\u2460\u6709\u6700\u7d42\u52dd\u8a34\u4e4b\u5408\u7406\u6a5f\u6703\uff08reasonable likelihood of success on the injury\uff09<br>\u53c8\u6cd5\u9662\u4ea6\u6703\u8003\u616e\u4e0b\u5217\u5404\u9ede<\/li>\n\n\n\n<li>\u2462\u767c\u7d66\u6216\u4e0d\u767c\u9810\u5099\u7981\u5236\u4ee4\u5c0d\u5176\u4ed6\u5229\u5bb3\u95dc\u4fc2\u4eba\u4e4b\u4e0d\u826f\u5f71\u97ff<\/li>\n\n\n\n<li>\u2463\u516c\u76ca\u6027<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n<\/li>\n\n\n\n<li>\u640d\u5bb3\u8ce0\u511f\n<ol class=\"wp-block-list\">\n<li>\u586b\u88dc\u6027\u8ce0\u511f\uff08compensatory damages\uff09<br>35USC \u00a7284-1<br>Upon finding for the claimant the court shall award the claimant damages adequate to compensate for the infringement, but in no event less than a reasonable royalty for the use made of the invention by the infringer, together with interest and costs as fixed by profits\uff09\uff1b\u2461\u78ba\u5b9a\u4e4b\u5be6\u65bd\u5831\u916c\u91d1\uff08established royalty\uff09\uff1b\u53ca\u2462\u5408\u7406\u4e4b\u5be6\u65bd\u5831\u916c\u91d1\uff08reasonable royalty\uff09\u3002<\/li>\n\n\n\n<li>4.1.1\u640d\u5931\u5229\u76ca<br>\u5c08\u5229\u6b0a\u4eba\u5fc5\u9808\u8b49\u660e\u640d\u5bb3\u984d\u548c\u4fb5\u5bb3\u884c\u70ba\u4e4b\u56e0\u679c\u95dc\u4fc2\u3002<\/li>\n\n\n\n<li>4.1.2\u78ba\u5b9a\u4e4b\u5be6\u65bd\u5831\u916c\u91d1<br>\u5c08\u5229\u6b0a\u4eba\u5982\u5df2\u5c07\u8a72\u5c08\u5229\u6388\u6b0a\u591a\u6578\u4eba\u5be6\u65bd\u6642\uff0c\u5c08\u5229\u6b0a\u4eba\u53ef\u4e3b\u5f35\u6b64\u4e00\u78ba\u5b9a\u4e4b\u5be6\u65bd\u5831\u916c\u91d1\u76f8\u7576\u984d\u4e4b\u640d\u5bb3\u3002<br>\u5982\u6709\u6b644.1.2\u9805\u5247\u4e0d\u80fd\u8acb\u6c42\u66f4\u9ad8\u984d\u4e4b4.1.1\u9805<br>\u540c\u6642\u5982\u67094.1.2\u9805\u5247\u8996\u70ba\u662f4.1.3\u9805\u4e4b\u5408\u7406\u5be6\u65bd\u5831\u916c\u91d1\u3002<\/li>\n\n\n\n<li>4.1.3\u5408\u7406\u5be6\u65bd\u5831\u916c\u91d1<br>\u6cd5\u9662\u4e0d\u5f97\u5224\u6c7a\u6bd4\u5408\u7406\u5be6\u65bd\u5831\u916c\u91d1\u66f4\u4f4e\u4e4b\u6578\u984d\u3002<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n\n\n\n<ul class=\"wp-block-list\">\n<li>4.2\u61f2\u7f70\u6027\u640d\u5bb3\u8ce0\u511f\uff08punitive damages\uff09<br>\u7b2c284\u689d\u898f\u5b9a\u6cd5\u9662\u53ef\u589e\u52a0\u640d\u5bb3\u984d\u81f33\u500d\uff08the court may increase the damages up to three times the mount found or accessed.\uff09\uff0c\u6b64\u70ba\u7f8e\u570b\u6cd5\u4e4b\u4e00\u5927\u7279\u5fb5\u3002<br>\u4e00\u822c\u5176\u50c5\u9650\u65bc\u6545\u610f\u4fb5\u5bb3\uff08willful \u8aee\u8a62\u5f8b\u5e2b\u7684\u8abf\u67e5\u50c5\u70ba\u8868\u9762\u6027\u6216\u4e0d\u5145\u5206\uff0c\u5247\u8996\u70ba\u6545\u610f\u4fb5\u5bb3\u3002<br>\u56e0\u6b64\u5728\u7f8e\u570b\u5be6\u52d9\u4e0a\u65bc\u88fd\u9020\u8ca9\u552e\u524d\u5fc5\u9808\u9810\u5148\u62ff\u5230\u5c08\u5229\u5c08\u9580\u5f8b\u5e2b\u51fa\u5177\u4e4b\u4e0d\u4fb5\u5bb3\u4e4b\u610f\u898b\u66f8\u800c\u4ee5\u5f8c\u624d\u4e0d\u6703\u88ab\u8a8d\u5b9a\u70ba\u6545\u610f\u4fb5\u5bb3\u3002<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>4.3\u5224\u6c7a\u524d\u4e4b\u5229\u606f<br>\u57281983\u5e74\u6700\u9ad8\u6cd5\u9662\u8a8d\u70ba\u5982\u975e\u7279\u5225\u60c5\u5f62\u5224\u6c7a\u524d\u4e4b\u5229\u606f\u5747\u9808\u7d66\u4ed8\uff0c\u800c\u53ef\u5426\u5b9a\u6b64\u7a2e\u8acb\u6c42\u4e4b\u60c5\u5f62\u5247\u70ba\u4f8b\u5982\u5c08\u5229\u6b0a\u4eba\u81ea\u5df1\u4e0d\u7576\u9072\u5ef6\u63d0\u8d77\u8a34\u8a1f\u7b49\u3002<br>\u4f46\u61f2\u7f70\u6027\u640d\u5bb3\u8ce0\u511f\u90e8\u4efd\u5247\u4e0d\u5f97\u8acb\u6c42\u7d66\u4ed8\u5229\u606f\u3002<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>4.4\u5f8b\u5e2b\u8cbb\u7528<br>\u7b2c285\u689d\u898f\u5b9a\uff0c\u6cd5\u9662\u5728\u4f8b\u5916\u6848\u4ef6\u53ef\u88c1\u5b9a\u5c0d\u52dd\u8a34\u4eba\u5408\u7406\u7d66\u4ed8\u5f8b\u5e2b\u8cbb\u7528\u3002<br>\u300c\u4f8b\u5916\u6848\u4ef6\u300d\u6700\u5178\u578b\u8005\u70ba\u6545\u610f\u4fb5\u5bb3\uff0c\u53e6\u5916\u4ea6\u542b\u6709\u88ab\u544a\u4e0d\u7576\u9072\u5ef6\u61c9\u8a34\u4e4b\u60c5\u5f62\u3002<\/li>\n<\/ul>\n\n\n\n<div
